Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Waydle app and website (collectively, the “Services”). By creating an account or using Waydle, you agree to these Terms. If you do not agree, do not use the Services.

1. Who Can Use Waydle

You must be at least 13 years old to use Waydle. By using the Services, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

You may only create one account for your own personal use. You may not share your account with others or create accounts on behalf of others.


2. Your Account

You are responsible for maintaining the security of your account and password. Waydle is not liable for any loss or damage resulting from unauthorized access to your account.

You agree to provide accurate information when creating your account and to keep it up to date. Your username is derived from your email address by default and is visible to other users. You can change it at any time in your profile settings.


3. Your Content

What You Own

You retain ownership of the content you post to Waydle, including bird sightings, session notes, and photos (“Your Content”).

License You Grant Us

By posting content to Waydle, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, store, display, reproduce, and distribute Your Content in connection with operating and improving the Services.

Data Licensing

By using Waydle, you also grant us a perpetual, royalty-free, worldwide license to use, aggregate, anonymize, and commercially license your contributed data — including bird sightings, location data, and other content — for any purpose, including wildlife research, conservation initiatives, academic partnerships, city planning, government agency partnerships, and commercial data licensing arrangements. Your personal information is never included in any externally shared or licensed data. This license survives account deletion.

What You're Responsible For

You are solely responsible for Your Content and the consequences of posting it. By posting content, you represent that:

  • You have the rights necessary to post it
  • It does not violate any law or third-party rights
  • It is accurate to the best of your knowledge

4. Acceptable Use

You agree not to use Waydle to:

  • Post content that is false, misleading, harassing, abusive, defamatory, obscene, or illegal
  • Impersonate any person or entity
  • Post content that infringes on any intellectual property or privacy rights
  • Scrape, crawl, or extract data from the Services without our express written permission
  • Attempt to gain unauthorized access to any part of the Services or other users' accounts
  • Use the Services for any commercial purpose without our prior written consent
  • Interfere with or disrupt the Services or servers connected to them
  • Post content that reveals sensitive locations such as rare bird nesting sites without appropriate context

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts that engage in prohibited conduct.


5. Location and Safety

Waydle uses location data to enable core features including session logging and nearby sightings. You accept all risks associated with sharing your location through the Services.

We recommend not logging sessions from private property or sensitive locations you do not want others to discover. You are responsible for your own safety while birding and while using the Services.


6. Intellectual Property

The Waydle name, logo, app design, and all related technology are owned by Waydle and protected by applicable intellectual property laws. You may not use our name, logo, or branding without our prior written permission.

Waydle may display, reference, or incorporate content, data, and materials sourced from third parties, including but not limited to public datasets, open databases, and openly licensed media. All such third-party content remains the property of its respective owners and is used in accordance with their applicable licenses and terms. Waydle makes no claim of ownership over any third-party content displayed within the Services.


7. Third-Party Services

The Services rely on third-party services including Supabase, Vercel, Cloudflare, Komoot Photon, and others. We are not responsible for the availability, accuracy, or conduct of these services.

Links or references to third-party websites or content do not constitute endorsement by Waydle.


8. Monetization and Changes to the Services

We may in the future offer premium features, display advertising, or enter into commercial partnerships. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.


9. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Services will be uninterrupted, secure, or error-free
  • Any information obtained through the Services will be accurate or reliable
  • Defects in the Services will be corrected

Bird occurrence data and sighting information displayed in the Services is provided for informational and recreational purposes only. We make no representations about the accuracy of species identification, location data, or any other content.


10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAYDLE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability will be limited to the fullest extent permitted by law.


11. Indemnification

You agree to indemnify, defend, and hold harmless Waydle and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of the Services
  • Your Content
  • Your violation of these Terms
  • Your violation of any rights of another person or entity

12. Termination

We may suspend or terminate your account at any time, with or without cause, and with or without notice. You may delete your account at any time through the app.

Upon termination, your right to use the Services ceases immediately. Sections 3 (Your Content — Data Licensing), 9 (Disclaimers), 10 (Limitation of Liability), 11 (Indemnification), and 13 (Governing Law) survive termination.


13. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the Services shall be resolved through binding individual arbitration in Texas, and you waive any right to participate in a class action lawsuit or class-wide arbitration. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction.


14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
